The Stove Barn Ltd Terms and Conditions

Please read the following information carefully before placing any order, on accepting a quote, you are deemed to have read, understood and agreed to abide by the terms stated here and any additional bespoke terms and conditions provided on your quote. We have included these terms and conditions so that you can be clear on what to expect by purchasing products and services from The Stove Barn Ltd.

ESTIMATES, QUOTATIONS AND ORDERS

Acceptance of Work: We reserve the right not to accept work once a quotation has been given, circumstances outside of our control may limit our ability to undertake the work to the agreed quotation such as price increases, discontinued products etc.

Change of Dates: We reserve the right to make amendments to any date given in good faith – we try our very best to stick to any agreed date but sometimes due to reasons out of our control we may have to arrange a change of date for installation. We will not be held liable for any direct or indirect losses as a consequence of a date change. We will endeavour to give as much notice as reasonable to ensure disruption and inconvenience is minimised.

Stove Lead Times: Some stoves have a longer lead time, this can be discussed during the survey and bookings will be made accordingly, be aware that upon choosing a product that is not readily available we can usually only give an approximate date of delivery/installation, we will not be responsible for any losses incurred either directly or indirectly as a consequence of having to change this date due to availability from a third party.

Storing Goods Purchased: Where we have taken delivery of goods against a customer’s order and the customer asks for the installation date to be deferred, we shall store the customers items free of charge for up to 4 weeks. We reserve the right to request that the balance is paid in full on or by the original installation/delivery date.

Use of Micafil / Leca: Where Vermiculite is used to insulate a chimney, we have provided an estimate only of the number of bags required to provide adequate insulation. On completion of the works, the invoice will be revised to reflect the actual number of bags used.

Scaffolding Costs – Unexpected: Where a quote does NOT include scaffolding but once works commence it comes to light that in order to maintain the safety of our workers, a scaffolding is required, it is the customers responsibility to cover the cost of this. We will endeavour to advise the customer of this requirement at initial survey, but this is not always possible.

Additional Contracted Works: We are not responsible for any work that has not been carried out by The Stove Barn Ltd. Where electrical, joinery, plumbing works or other specialist works not undertaken by The Stove Barn are required or quoted, this work is not deemed as subcontracted work via The Stove Barn, we by way of contacts are providing you with a direct link to an non-associated contractor whom you may wish to use to complete the specialist works, you are not obliged to use these and their works do not form part of your contract with The Stove Barn Ltd. Estimates provided by other contractors are subject to change and The Stove Barn are not held liable for any works or costs relating to works completed by contractors introduced by The Stove Barn Ltd.

Purchases without advice: Where advice has not been sought by the customer or given by The Stove Barn Ltd in relation to the suitability of a specialist product in resolving any known issues with chimney or stove and / or where the customer has specifically requested this particular product to be installed. The Stove Barn accepts no responsibility for the performance of the product in resolving any known issues.

Use of Estimate Only: Where an Estimate has been provided for Materials and /or Labour – this will be amended according to actual hours / days and materials used. This method of quoting is only used where the complexity of the job does not allow us to provide a definitive costing without applying unreasonable contingencies to the costings therefore an estimate is provided to allow the customer to make an informed decision with reasonable indication of costs. The acceptance of an estimate acknowledges that costs may change.

Indirect Losses: We will not take responsibility for any losses ether direct or indirect if we have to cancel or change an installation date due to a third party failing to provide their services on time, this includes third party chimney sweeps and scaffolders.

PAYMENT

Methods of Payment: We accept payment by BACs, Cheque, Debit/Credit Card and Cash.

Deposits: A non-refundable deposit of an agreed amount is taken at the time of booking to secure the slot, this is usually the price of your given appliance. This is payable before your appliance or any products are ordered. Your specific deposit amount will be communicated to you. No order for any products will be placed with our suppliers without a deposit payment being received.

Remaining Balance: The remaining balance is to be paid no more than 5 days after completion of the works unless otherwise agreed or works are in dispute. Registration and Warranties of Products and Services will not be completed until full payment is received for any outstanding amounts.

Interest on Overdue Accounts: We reserve the right to charge 5% per day for outstanding accounts.

PRODUCT SPECIFICATIONS, INFORMATION & WARRANTY EXCLUSIONS.

Illustrative Images: All images of products illustrated by means of product brochures, our web site and / or links to our supplier websites should be regarded as “illustrative” ONLY as details may be subject to change without prior notice due to the manufacturer having a policy of on-going product development. We will of course endeavour to bring to your attention any detail changes of which we are aware, however goods supplied may differ slightly as a consequence.

Technical details: Dimensions provided by us and our suppliers should be regarded as “nominal” and as a guide only due to manufacturing tolerances.

Specification Errors – Customer Information supplied: We will not accept any liability to supply additional materials or incur costs where the buyer/customer has provided us with inaccurate and /or incomplete dimensions / information and the product(s) supplied are therefore incorrect or incomplete as a result.

Colours: Colours may vary slightly from those illustrated.

Warranty -Consumable Parts: Stove warranties normally exclude naturally wearing ‘consumable’ parts such as: Glass & seals, firebricks, grate parts, baffles, log retainers, pilot assemblies, thermocouples, fuel effects and the surface finish of the unit.

Warranty – Liners: Most stoves, stainless steel flue liners & cowls are not designed for burning processed smokeless fuels or processed wood with added chemicals, use of which will void the manufacturer’s guarantee. Always look for the HETAS approved and Ready to Burn Fuels. Your liner has a lifetime guarantee.

Warranty – Services: All services provided by The Stove Barn Ltd are covered by a 12-month Warranty, however, if you are experiencing issues outside of this period, we advise you to contact us in the first instance to assess.

Flexible Liners: A 316 flue liner is recommended for the use of burning wood only, if you are purchasing a multi fuel stove and intend on burning smokeless fuel we would suggest that you upgrade this option to a 904 flue liner.

Chimney systems: When fitting a new twin wall flue system, it will need repositioning several times during the assembly process. The outer skin is very thin & it is inevitable that several small scratches & even dents may occur during this process, this in no way effects the performance, small indents and scratches need to be accepted as part of the fitting process.

Alignment of Chimney Systems: Where we have to pass through a roof structure or wall, to conform to regulations with regard to distances from combustible material and windows etc it may not be possible to align the appliance exactly where we would like to. We will where possible discuss this at time of survey but cannot guarantee a particular placement or final ‘look’.

Downdraft Issues: Cold chimneys in particular external steel chimney are subject to extreme downdraft, they may require pre heating in order to induce an initial updraft prior to lighting. As standard we will fit a bird guard style or antidown draft cowl, if upgrades are required to eliminate downdraft further, the customer will be liable for any additional product and fitting costs. We are unable to assess weather conditions which may adversely affect the performance of the stove and liner system at time of survey.

General Information: Information and contents on www.the-stove-barn.com, our face book page and links to our suppliers and their associated information must be regarded as being for guidance only, and we shall not be responsible for any misinterpretation or misrepresentation.

PREPARATION OF WORK AREA

Chimney Sweep: As best practise dictates, we usually sweep a chimney as part of your installation before we carry out any work, however, in some instances we may ask that you arrange to have your chimney swept to ensure it is free of excess soot and obstructions, this will be discussed explicitly and communicated in writing if this it required. Instances where we may require a chimney sweep is if there are known issues with blockages etc which may take a significant amount of time to remove before commencing of works.

Declutter and Cover Up: Any room that we are working in should be cleared of clutter and any furniture or valuable items moved out of the way and covered with dust sheets, we will cover carpets with disposable sheeting to protect floors. Although great care will be taken, we cannot be responsible for any items, flooring or furnishings that are damaged by soot from an existing chimney.

Smokeless Zones: Due to constantly changing regulations it is the sole responsibility of the customer to ensure PRIOR to purchase that local regulations permit the installation and use of wood fired appliances at their post code (example smokeless zones). Smoke control areas: the rules – GOV.UK (www.gov.uk)

Approvals: Where a new chimney(s) is/are required (masonry or prefabricated) the customer is solely responsible for seeking advice from the local authority that this is permitted and if necessary, obtain planning approval prior to committing to purchase / installation. (Smokeless zones, Listed building, conservation area)
It is NOT the responsibility of The Stove Barn Ltd or its agents to seek these approvals and we shall not be held responsible in any respect for any installations carried out without the required local authority approvals.

DIY Works: Where customers are completing parts of the installation themselves, i.e. – building works, the technical specification of the products used and / or photographic evidence must be submitted and approved by The Stove Barn Ltd before commissioning of installation will take place. All works must be completed as recommended by The Stove Barn and / or in accordance with current building regulations Doc J.

INSTALLATION / COMPLETION OF WORKS

Skirting Boards: Removal/replacement of skirting boards is not included in your quotation unless agreed otherwise. It is usual for us to cut down existing skirting board when completing a chamber knockout, but the edges are not finished, or skirting replaced as part of these works.

Damage to Roof Tiles: Every care is taken when works are carried out on the roof, however if the roof is in poor condition, (loose ridge tiles, rotten battens, loose or de laminated tiles or slates) We cannot be held responsible for further damage to tiles, slate, felt, battens lead etc.

Assessment of Chimney Stack: Whilst working on roofs / Chimney Stacks, a general assessment of the Chimney Stack, Leading and flaunching will be undertaken and verbally reported back if in bad condition or requiring some attention. Completion of this work is not included in your quote. At times it may be possible for us to complete at time of install, but written agreement of the quoted price must be given and accepted before commencing.

Chimney Pot Replacements: It is not possible at the time of survey to assess whether a new chimney pot will be required for the relining of existing chimneys, some pots we are unable to secure to or become damaged, we reserve the right to replace any broken chimney pot with new and this will be charged to customer as an addition to the agreed quote.

Re-Commission of existing installations: When connecting appliances to an existing liner system already installed by a competent person (registered with HETAS) The Stove Barn do not accept liability for the liner nor re-register the installation with building control. Where an appliance is connected, we will re-connect the new appliance in accordance with Doc J regulations, smoke test the liner and provide the necessary documentation and registration relating to the appliance only. We are unable to provide documentation for the liner system as warranty claims with this system cannot be processed through ourselves and must be address to the original installer / business.

Faulty Products Previously installed: On inspection of existing liner systems, if found to be inadequate, illegal or unsafe as deemed by our registered installer, we reserve the right not to connect a stove to this liner system. We will advise on a necessary course of action to bring this up to current regulations.

Waste Removal: Any rubbish / rubble will be removed from site unless otherwise agreed and noted on quote / invoice.
Knockout of Chamber: Where we have quoted to open up the chimney chamber, this will be to the original dimensions only, or a structurally safe dimension. Please note that although we provide quotations in good faith it is not always possible to know the size of any opening unless it is visible at the time of the survey a best estimate of size will be provided if possible, at time of survey. The knockout price will include the patching in of plaster works, this will be done to the highest standard possible by our inhouse plasterer, however we will not be responsible for any unevenness where the new plaster meets the existing, A quotation can be given for taking the whole chimney breast back to brick or a full reskim, to achieve a neater plaster finish, this can be discussed during your survey. It is normal and unavoidable for shrinkage cracks to appear in the plaster.
Finish of products: If you are choosing to open up the chimney chamber and using the natural brick as a background, although great care will be taken, we cannot guarantee the finish on the edges or face of the brickwork if we have had to knockout to enlarge the opening.

Fireboard Line: If you are wanting a lined chimney chamber with the intention of painting for a smoother finish, please be aware that the material used for this purpose is a non-combustible board which does sometimes craze when exposed to continuous heat. Heat Shield for Wooden Beams: In most instances in order to meet current regulations it will be necessary for us to fit a heat shield to protect the underside of your wooden beam from excessive heat. This is made from1.5mm thick galvanised steel and will be fixed under the beam with an air gap between the wood and steel. We advise you to view an installed heat deflector at our showroom, as this forms a necessary part of meeting current regulations, if you do not want a heat deflector fitted you must choose a cast beam which is non combustible instead.

Natural Products: Our stone hearths and Beams are totally natural products and as such have unique characteristics, no two slabs, beams or tiles are the same. Variations in shading, colour, and texture are to be expected. Any samples of natural products are for giving an approximate representation of the Goods only. All samples have been prepared to a presentation standard and allowed to dry; they have not been sealed unless stated. There can be further surface cracking of beam safter installation, this is part of the drying our process and can’t be anticipated. Beams have been seasoned for 2 years prior to finishing. AFTER INSTALLATION
Notification of Issues: We advise you to check over the finishes of the products and services received at time of handover and advise our team of any issues which may require attention. Alternatively, you have up to 5 days after completion to notify us of any outstanding issues.
Stove Lighting: We will demonstrate the operation of the stove to you during handover, if after this you experience problems lighting the stove, we advise you to contact us in the first instance for advice.
Call out Charges: We reserve the right to charge a call out fee of £50 + vat where on inspection there is no issue with the stove or installation, the issue is found to be a user error.
Warranties and Certificates of Compliance will not be registered until payment has been received in full.
SAFETY INFORMATION
Due to the risk of carbon monoxide poisoning with burning any combustible materials in an enclosed space it is law that a CO detector is fitted after installation in the room where the fire has been fitted, this forms part of your quote in all instances of stove installation. We may also recommend, installation of additional carbon monoxide alarms to bedrooms above the fire chamber and have a functioning fire alarm fitted within an appropriate position within the house.

Always follow the manufacturer’s instructions and use your stove responsibly. We are not liable for any safety issues arising due to improper use. If you do not have a copy of the user manual, please ensure you contact us or the manufacturer to obtain one immediately.

Do NOT burn anything other than wood on a wood burning stove unless the manufacturer explicitly within the operating manual advises that this is ok, we will not be held liable for any damage as a result of misuse of appliance and liner.

Do not burn standard house coal on a closed appliance, this will render your warranties void.

Most chimney liner manufacturers have testing kits and will take samples for analysis to determine what fuel has been used for warranty claims and criminal investigations.

Your chimney liner should be swept twice per year to prevent build up which restricts air flow and compromises the durability of the liner, we offer this service for existing customers, please contact us for more details.
Your manual should advise on whether your appliance is suitable for continuous or intermittent burning. This refers to the stove’s refuelling interval requirements to obtain the full (nominal) heat output, as certified by the CE testing station. Continuous Operation stoves are able to demonstrate a minimum refuelling interval at the full rated (nominal) output of not less than 4 hours for solid fuel burning or 1.5 hours when burning wood and have the ability to hold a fire at low burning rate and be revived after no less than 12 hours for solid mineral fuel and 10 hours for wood logs. These appliances will suit people who don’t want to keep lighting their fire up from cold. They can be used more as a primary source of heat. Stoves are classed as ‘intermittent operation’ when, to give the full (nominal) output, you have to refuel at least every 45 minutes for wood, or 1 hour for solid fuel.
